		<head>Collection Overview</head>
		<p>The papers of
		  <persname>James Buchanan Duke </persname>span the years 1777 to 1990,
		  although the bulk of the material dates from the 1890s to the mid-1930s. They
		  consist of correspondence; business, legal, and financial papers; printed
		  materials; and visual materials. The collection documents
		  <persname>James B. Duke's </persname>business and financial
		  investments, and some aspects of his philanthropy. About one half of the
		  collection documents the administration of the
		<title render="italic">Estate of James B. Duke, Deceased,</title>
		including legal proceedings stemming from claims made against the estate.
		Subject areas represented in the collection include: business and finance;
		philanthropy; genealogy on branches of the
		<famname>Duke </famname>family; inheritance; legal procedure;
		architecture and interior decoration; and, to a lesser degree, family life.</p>

		<p>Although the <emph render="bold">Correspondence Series</emph>
		  primarily relates to business topics, personal letters are scattered
		  throughout. Financial transactions, such as exchanges of stocks and cash, which
		  often occurred between members of the
		  <famname>Duke </famname>family, are recorded in both the
		  <emph render="bold">Correspondence</emph> and <emph render="bold">Financial
		  Papers Series</emph>. Aspects of both familial and business relationships
		  between brothers, James B. and Benjamin Newton Duke, and their father,
		  <persname>Washington Duke, </persname>are documented through their
		  correspondence. James B. Duke often received requests from individuals, many of
		  them strangers, for financial aid and other forms of assistance or favors, such
		  as making investments and employment. Written exchanges also document various
		  aspects of the Duke tobacco businesses, the professional relationships of
		  <persname>James B. and Benjamin N. Duke </persname>with other members
		  of the business community, and personal and business financial transactions.
		  Correspondents include
		  <persname>Lida Duke Angier (Mrs. J.C. Angier), </persname>
		  <persname>Richard B. Arrington, </persname>
		  <persname>W.T. Blackwell, </persname>
		  <persname>Betty Roney Daily (Mrs. John C. Daily), </persname>
		  <persname>Benjamin Newton Duke, </persname>
		  <persname>Washington Duke, </persname>
		  <persname>George Watts Hill, </persname>
		  <persname>Maude D. Karnes, </persname>
		  <persname>William R. Perkins, </persname>and
		  <persname>Alexander H. Sands.</persname> </p>
		<p>
		  <persname>James Buchanan Duke </persname>was known for his business
		  acumen, especially in national and international tobacco industries and
		  hydroelectric power. The <emph render="bold">Business Papers Series</emph>
		  furnishes partial documentation for some of his businesses. The most complete
		  records are for
		  <corpname>Duke Farms Company</corpname> in Somerville, N.J. (apparently
		  a holding company). The Duke Farms Company's records include documentation for
		  <corpname>Piedmont Electro-Chemical Company, </corpname>
		  <corpname>Southern Power Company, </corpname>
		  <corpname>Orlando Water Power Company, </corpname>and other Duke-owned
		  businesses. Mr. Duke made substantial investments in textile mills and
		  corporations, such as the
		  <corpname>Aluminum Company of America. </corpname>Records of his
		  investments, including extensive stocks and bonds transactions, are in the
		  <unittitle>Business and Financial Papers Series.
			 </unittitle>Acquisition of exclusive rights to a cigarette manufacturing
		  machine produced by the
		  <corpname>Bonsack Machine Company, </corpname>which allowed for very
		  rapid processing of cigarettes, enabled the Duke companies to move into the
		  forefront of the cigarette industry. Extensive correspondence documents the
		  negotiations between
		  <persname>James B. Duke, </persname>President of
		  <corpname>The American Tobacco Company, </corpname>and
		  <persname>D.B. Strouse </persname>and
		  <persname>P.A. Krise, </persname>of the
		  <corpname>Bonsack Machine Company. </corpname>It is filed in the
		  Business Papers Series under both the
		  <corpname>Bonsack Machine Company </corpname>and the
		  <corpname>W. Duke, Sons and Company </corpname>and occurs in
		  <corpname>The American Tobacco Company </corpname>letterbook. After the
		  dissolution of
		  <corpname>The American Tobacco Company </corpname>in 1911, Mr. Duke
		  focused his attention more on the hydroelectric power industry than on tobacco.
		  Histories of some of
		  <persname>James B. Duke's </persname>businesses and investments,
		  especially hydroelectric power, are in the <emph render="bold">Miscellaneous
		  Series</emph>. Many of Mr. Duke's business investments and other enterprises
		  were continued after his death by his executors until the estate was
		  liquidated.</p>
		<p>The philanthropic work of
		  <persname>James B. Duke </persname>included contributions to
		  <corpname>Duke University (Trinity College) </corpname>and other
		  educational institutions, a fund for <emph render="doublequote">worn-out</emph>
		  Methodist preachers, an endowment for
		  <corpname>Lincoln Hospital (</corpname>designated for use only by a
		  black institution), funds for building churches, and other charitable causes.
		  Representatives of educational institutions and churches wrote to request
		  various types of financial support from Mr. Duke, including endowments and
		  one-time donations. Avenues for contributions to most of these institutions and
		  charities were later consolidated under the auspices of the
		  <corpname>The Duke Endowment. </corpname>Information about Mr. Duke's
		  philanthropic activities is documented in the <emph render="bold">Correspondence</emph>, <emph render="bold">Financial</emph>, and
		  <emph render="bold">Legal Papers Series</emph> </p>
		<p>Mr. Duke owned homes and estates in
		  <geogname>New York, N.Y., </geogname>
		  <geogname>Somerville, N.J., </geogname>
		  <geogname>Charlotte, N.C., </geogname>and
		  <geogname>Newport, R.I. </geogname>The houses contained many works of
		  art and antiques, and the grounds of the Somerville estate,
		  <corpname>Duke Farms, </corpname>were renowned for their statuary and
		  landscaping. Records for architecture, decoration and renovation, deeds and
		  property transfers, and maintenance of Mr. Duke's properties are found
		  throughout the collection. Volumes in the <emph render="bold">Financial Papers
		  Series</emph> have entries for household and estate expenditures. Considerable
		  information for the
		  <corpname>Duke Farms </corpname>estate in
		  <geogname>Somerville, N.J., </geogname>is in the <emph render="bold">Correspondence and Business Papers Series</emph>. Other
		  information about various homes and properties, including architectural plans
		  by
		  <persname>Horace Trumbauer, </persname>is in the <emph render="bold">Pictures and Miscellaneous Series</emph>. Detailed inventories of
		  properties, including furnishings, are in the Petitions on First and Final
		  Accountings filed in the <emph render="bold">Estate, Legal Papers
		  Subseries</emph>.</p>
		<p>The Last Will and Testament of
		  <persname>James B. Duke </persname>and its Codicil included provisions
		  for trusts including
		  <corpname>The Doris Duke Trust, </corpname>
		  <corpname>The Duke Endowment, </corpname>and for individuals, such as
		  <persname>Nanaline H. Duke </persname>and
		  <persname>Doris Duke. </persname>Item VI of the Will of
		  <persname>James B. Duke </persname>provided for the distribution of two
		  million dollars to living descendants of the brothers and/or sisters of
		  <persname>James B. Duke's father, </persname>
		  <persname>Washington Duke, </persname>and his mother,
		  <persname>Artelia Roney Duke. </persname>The executors of the estate,
		  <persname>Nanaline H. Duke, </persname>
		  <persname>William R. Perkins, </persname>and
		  <persname>George G. Allen </persname>conducted a prolonged
		  investigation to determine who were legitimate heirs under Item VI of the will.
		  Earlier, in 1924,
		  <persname>Benjamin N. Duke </persname>had begun to try to identify
		  individuals who were related to him through his father and mother. After
		  <persname>James B. Duke's </persname>death,
		  <persname>Benjamin N. Duke's </persname>earlier communications with
		  <emph render="doublequote">Duke</emph> family members were closely scrutinized,
		  especially his correspondence with
		  <persname>Edna L. Vaughan </persname>of
		  <geogname>Warrensburg, Mo. </geogname>Some of these letters were later
		  used as legal evidence when
		  <persname>James B. Duke's </persname>will was disputed. Genealogical
		  information related to inheritance under
		  <persname>James B. Duke's </persname>will is scattered throughout the
		  <emph render="bold">Correspondence Series</emph>, especially in the years 1924
		  and 1925. The <emph render="bold">Estate Series</emph> also contains extensive
		  correspondence and other documents that contain genealogical information about
		  various Duke families. A significant portion of the series documents the
		  settlement of Item VI of Mr. Duke's will.</p>
		<p>The <emph render="bold">Estate, Correspondence Subseries</emph>
		  includes inquiries to the executors and to
		  <persname>Benjamin Newton Duke </persname>from individuals or their
		  attorneys who thought that they were related to
		  <persname>James B. Duke </persname>and wanted to file a claim for the
		  inheritance under Item VI. The executors responded to most initial inquiries
		  from claimants in November 1925 with a form letter which required them to
		  submit affidavits stating their relationship to
		  <persname>James B. Duke. </persname>Usually three affidavits were
		  submitted: one by the claimant and two from individuals who stated their
		  knowledge of the claimant and the alleged relationship to
		  <persname>James B. Duke. </persname>To gather more information, in
		  January 1927 the executors sent claimants a questionnaire about detailed
		  genealogical history. Most affidavits and questionnaires are in the
		  <emph render="bold">Estate, Legal Papers Subseries</emph>, but some are
		  scattered in the <emph render="bold">Estate, Correspondence Subseries</emph>
		  which also has information about evidence used in the court hearings.</p>
		<p>Two sets of claims posed particular problems for the executors and are
		  extensively documented in the <emph render="bold">Estate, Correspondence and
		  Legal Papers Subseries</emph>. These claims, one from the
		  <famname>Vaughan </famname>family and another group claim from
		  individuals associated with
		  <persname>Elizabeth Duke </persname>of
		  <geogname>Marshall and Wichita Falls, Tex., </geogname>were the subject
		  of extensive correspondence. They were researched in great detail by
		  <persname>Charles Caldwell, </persname>a lawyer, and brought to the
		  courts in
		  <geogname>New Jersey </geogname>for final determination.
		  <persname>Elizabeth Duke </persname>claimed a relationship through
		  <persname>Thomas Duke; </persname>the
		  <famname>Vaughan </famname>family claimed theirs through
		  <persname>Polly (Mary) Duke Vaughan. </persname>
		  <persname>Caldwell </persname>was engaged by the executors in May 1927
		  to conduct detailed research into these claims. The investigation generated
		  extensive, detailed documentary genealogical information regarding not only the
		  families of
		  <persname>Washington Duke </persname>and
		  <persname>Artelia Roney Duke </persname>but also about other families
		  that claimed a Duke family connection.
		  <persname>Charles Caldwell </persname>conducted research in archives
		  and interviewed claimants in
		  <geogname>Louisiana, </geogname>
		  <geogname>Texas, </geogname>
		  <geogname>Georgia, </geogname>
		  <geogname>Missouri, </geogname>and
		  <geogname>North Carolina. </geogname>While his research primarily
		  documents individuals whose claims were spurious, the information collected by
		  <persname>Caldwell </persname>also describes, to a more limited extent,
		  the claims of legitimate heirs. The executors published a book,
		<title render="italic">Determination by the Executors of James B. Duke,
		  Deceased . . .</title> (1927), with appended schedules of allowed and rejected
		claims, that discusses the settlement of the will.</p>
		<p>
		  <persname>Lida Duke Angier (Mrs. J. C. Angier) </persname>and
		  <persname>Betty Roney Daily (Mrs. John C. Daily), </persname>
		  <persname>James B. Duke's </persname>cousins, worked with the executors
		  to find information that would determine legitimate heirs. Letters they wrote
		  reveal knowledge of the families of
		  <persname>James B. Duke </persname>and
		  <persname>Benjamin N. Duke. </persname>
		  <persname>Benjamin N. Duke's </persname>written responses to the
		  executors' requests for his knowledge of the relationships put forth by
		  claimants are dispersed in the correspondence. Other correspondents include
		  attorneys, archivists, genealogists, historians, and handwriting and other
		  document experts who were employed by the executors or who responded to their
		  requests for information. Experts also submitted reports of their findings.
		  Individuals represented in the <emph render="bold">Estate Series</emph> include

		<p>The <emph render="bold">Estate, Financial Papers Subseries</emph>
		  documents distributions made under most provisions of the will and expenses
		  incurred by the estate in administering the will, including those from legal
		  research and fees. Records for the distribution under Item VI of the will are
		  useful for information about individuals who were determined to be legal
		  heirs.</p>

		  <persname>James Buchanan Duke </persname>is the result of reprocessing,
		  including reorganization and consolidation, of the materials in 1991 and 1992.
		  This was undertaken to improve access for research and upgrade housing for the
		  materials. The materials are now fully integrated into the collection under
		  appropriate series and subseries. Throughout the collection, wherever
		  attachments to correspondence appeared to have been displaced, attempts were
		  made to re-establish these links. Check books were disbound and the check stubs
		  filed in folders. Duplicate materials were removed.</p>
		<p>Materials generated during the settlement of the
		<title render="italic">Estate of James B. Duke, Deceased,</title> and the
		determination of heirs under his will are all filed in the
		<unittitle>Estate Series </unittitle>in three sections,
		<unittitle>Correspondence,</unittitle>
		<unittitle> Legal Papers, </unittitle>and
		<unittitle>Financial Papers Subseries. </unittitle>The materials that
		were formerly filed as Research Records of
		<persname>Charles Caldwell </persname>are now primarily filed in the
		<unittitle>Estate Series,</unittitle>especially the
		<unittitle>Legal Papers Subseries. </unittitle>The majority of
		<persname> Caldwell's </persname>papers are filed in folders labeled
		Discovery or Claims;
		<persname>Caldwell's</persname>notes are filed in chronological order and
		some correspondence is interfiled with the notes. Where there were no dates,
		the materials were kept in the order in which they were previously filed
		although some reconstruction of order was possible by comparing dated and
		undated manuscripts.
		<persname>Caldwell's </persname>reports to the executors and census and
		other records that he collected are filed separately from his notes. The
		provenance of the typed lists of names and relationships filed in the front of
		the
		<unittitle>Estate Series, Legal Papers Subseries,</unittitle>Claims
		folders is unclear. These lists may have been created and added to the
		collection when it was previously arranged. Most of the genealogical materials
		are filed in the
		<unittitle>Legal Papers Subseries</unittitle>under Claims. Evidence
		previously filed under correspondence is now in the subseries under Evidence
		with the index created by the lawyers.</p>
		<p>Some of the correspondence between
		  <persname>James B. Duke </persname>and
		  <persname>D. B. Strouse </persname>and
		  <persname>P. A. Krise </persname>of the
		  <corpname>Bonsack Machinery Company </corpname>was attached to the
		  pages of a set of three letterbooks. To comply with preservation needs, the
		  letterbooks were dismantled and the correspondence removed to three folders and
		  filed in the
		  <unittitle>Business Papers Series. </unittitle>The number of the
		  letterbook page from which the leaf was removed was copied to the letter and
		  the folders were arranged according to the arrangement of the original letter
		  books. There is an index to the correspondence from each letter book.</p>
		<p>Business, legal, and financial records pertaining specifically to the
		  administration of
		  <persname>James B. Duke's </persname>estate are filed in the Estate
		  Series. Similar records, not pertaining to the settlement of the estate, are
		  filed in the Business Papers, Legal Papers, and Financial Papers Series
		  regardless of their dates.</p>
